What is EB-5?

The EB-5 Immigrant Investor Program, created by the U.S. Congress in 1990, provides a pathway to U.S. permanent residency for qualified participants and their eligible family members. To meet program requirements, each investment must create or preserve at least 10 full-time jobs for American workers.

The EB-5 Reform and Integrity Act of 2022

The EB-5 Reform and Integrity Act (RIA) of 2022 strengthened the program with important updates. These include new integrity and transparency requirements that apply to regional centers and their operators; reserved visas for rural, high unemployment, and infrastructure projects; priority processing for rural projects; and enhanced protections for investors.

The Advantages of the EB-5 Reform and Integrity Act of 2022
Immigrant Visa Set-Asides

The RIA reserves EB-5 visas for rural, high-unemployment, and infrastructure projects, offering faster availability. ALC specializes in rural and infrastructure development, positioning our participants to benefit from these priority set-asides.

Concurrent Filing

The RIA allows applicants in the U.S. to file their EB-5 petition and permanent residence (adjustment of status) application together, which provides for immediate access to many of the benefits of permanent residence, namely work and travel authorization. ALC supports investors through this process with clear guidance and strong compliance oversight.

Strict Compliance and Investor Protection

The RIA requires all regional centers to undergo USCIS-mandated audits. In 2024, ALC successfully completed its audit, demonstrating our commitment to transparency and accountability in every step of the EB-5 process.

EB-5 Application Process

The EB-5 Program offers qualified foreign investors and their families the opportunity to obtain permanent U.S. residency by investing in job-creating projects.

STEP 1

Inside the United States (Concurrent Filing)

  • File Forms I-526E and I-485 concurrently when there is a visa available (estimated I-526E processing time: 14 months with some rural cases being approved in as little as 4 months)

Outside the United States

  • File Form I-526E (estimated I-526E processing time: 14 months with some rural cases being approved in as little as 4 months)

STEP 2

Inside the United States (Concurrent Filing)

  • If approved, applicants may receive employment authorization and advance parole to travel internationally (“Combo Card”)

Outside the United States

  • Submit NVC forms and fees

STEP 3

Inside the United States (Concurrent Filing)

  • If approved, applicants may receive conditional permanent residence (a Green Card valid for 2 years)

Outside the United States

  • If approved, the petition is transferred to U.S. Embassy or Consulate. Applicants then submit a medical examination form, undergo a visa interview, and upon approval receive conditional permanent residence (a Green Card valid for 2 years) and move to the United States.

STEP 4

Inside the United States – Removal of Conditions

  • If approved, applicants may remove conditions by filing Form I-829 (estimated processing time: 4 years)

STEP 5

If approved, applicants may receive Permanent Green Card
